Terms of Service

These Terms of Service ("Terms") govern your access to and use of Dayboard, operated by Creative Brackets AB (Org. Nr. 559002-9624), a company registered in Sweden ("Company", "we", "us", or "our").

By accessing or using Dayboard, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service.

1. The Service

Dayboard is a Software-as-a-Service (SaaS) platform designed to help individuals and teams start their day with clarity and focus. It provides a customizable digital dashboard where users can organize links, notes, tasks, calendars, habits, goals, and other productivity tools in one place.

Dayboard is intended to support focus and organization. It is not a project management system, financial system, or compliance tool, and should not be relied upon for critical or regulated use cases.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use Dayboard. By using the service, you represent and warrant that you meet these requirements.

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You agree to provide accurate, complete, and up-to-date information and to keep your account information current.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You must notify us immediately if you suspect unauthorized access or use.

3.3 Account Suspension and Termination

We may suspend or terminate your account if you violate these Terms, misuse the service, or engage in unlawful or harmful behavior. We may also suspend the service for maintenance, security, or operational reasons.

4. Subscription Plans and Billing

4.1 Plans

Dayboard offers multiple subscription plans, including a free tier and paid plans with additional features. Plan features, limits, and pricing are described on our website and may change over time.

4.2 Free Trial

Paid plans may include a 14-day free trial unless otherwise stated. If you do not cancel before the trial ends, your payment method will be charged automatically.

4.3 Billing

Subscriptions are billed annually in advance unless otherwise specified. All prices are listed in USD unless stated otherwise. Taxes may apply depending on your location.

You authorize us to charge your selected payment method on a recurring basis.

4.4 Payment Processing

Payments are processed by Stripe or another third-party payment provider. We do not store full payment card details on our servers.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

5.2 Refund Policy

• Within the free trial: full refund
• After the trial: no refunds for unused time or partial periods
• Service failures caused by us: refunds may be granted at our discretion

6. User Content

6.1 Ownership

You retain full ownership of all content you create, upload, or store in Dayboard ("User Content").

6.2 License

You grant us a limited, non-exclusive, revocable license to store, process, and display your User Content solely to operate and improve the service.

6.3 Responsibility

You are solely responsible for your User Content and confirm that you have all necessary rights to use it.

6.4 Prohibited Content

You must not upload content that:

• Is illegal, abusive, hateful, or harmful
• Infringes intellectual property or privacy rights
• Contains malware or malicious code
• Violates applicable laws or regulations

7. Acceptable Use

You agree not to:

• Use the service for unlawful purposes
• Attempt unauthorized access to systems or data
• Reverse engineer, decompile, or copy the platform
• Interfere with service performance or security
• Use automated scraping or bots without permission
• Resell or white-label the service without authorization

8. Intellectual Property

All intellectual property rights in Dayboard, including software, design, branding, and content (excluding User Content), are owned by Creative Brackets AB and protected by applicable laws.

No rights are granted to you except those expressly stated in these Terms.

9. Third-Party Services

Dayboard relies on third-party services, including but not limited to:

• Supabase (authentication and database)
• Stripe (payments)
• Google Analytics / Tag Manager (analytics)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU GDPR.

You are responsible for ensuring that any personal data you store in Dayboard complies with applicable laws.

11. Disclaimers

Dayboard is provided "as is" and "as available", without warranties of any kind, express or implied.

We do not guarantee uninterrupted service, error-free operation, or specific outcomes from using the platform.

12. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the greater of:
  - the amount you paid in the 12 months preceding the claim, or
  - USD 100

13. Indemnification

You agree to indemnify and hold harmless Creative Brackets AB from claims, damages, or expenses arising from your use of Dayboard, your User Content, or your violation of these Terms.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the service or email. Continued use after changes constitutes acceptance.

15. Termination

Either party may terminate these Terms at any time. Upon termination:

• Your access to Dayboard will end
• Data export may be requested within 30 days, subject to technical feasibility
• Sections that should survive termination will do so.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Sweden. Any disputes shall be resolved exclusively by Swedish courts.

17. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Creative Brackets AB regarding Dayboard.
